By accepting this CORA Health Services, Inc. Network Terms of Use (the “Network Terms of Use”) or accessing CORA’s Guest WiFi network (the “Service”), you hereby affirm and agree that you are at least 18 years of age, and have read, understand, and agree to be bound by this Network Terms of Use agreement.  References in the Network Terms of Use agreement to “you” or “your” means the individual user of the Service.  When we refer to “us,” “we,” or “our,” we mean CORA Health Services, Inc. 
i)	CORA Health Services, Inc. makes every effort to provide the best available technology to those performing services for CORA and CORA’s patients and their guests. CORA Health Services, Inc. reserves the right to change, update, or modify this Network Terms of Use agreement at any time without any notification. CORA Health Services, Inc. also reserves the right to remove and block any computer or device from the Guest WiFi Network, without notification.
ii)	By accepting this agreement or using the Service you hereby warrant and represent that you will use the Service in accordance with all applicable laws, rules, and regulations.  You further agree that you will fully defend, indemnify and hold CORE Health Services, Inc. harmless for any and all claims, actions, proceedings, and lawsuits, and pay (a) all damages, liabilities, and losses, (b) fees and expenses, including fees of legal counsel and experts), and (c) other costs arising from or in connection with your use or access to the Service and any violation by you of this Network Terms of Use agreement. CORA HEALTH SERVICES, INC. IS PROVIDING ACCESS TO THE SERVICES ON AN “AS IS” BASIS AND FULLY AND COMPLETELY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED REGARDING THE SERVICE.  IN NO EVENT SHALL CORA HEALTH SERVICES, INC.’S AGGREGATE LIABILITY EXCEED ONE HUNDRED U.S. (U.S. $100.00).  THE LIMITATIONS OF THIS SUBSECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, AND WHETHER OR NOT CORA HEALTH SERVICES, INC. HAS BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.  

1. Acceptable Use

1.1 CORA Health Services, Inc. is offering the Guest WiFi Network Service in accordance to this Network Terms of Use agreement as a free, non-public service to patients and their guests for the duration of the patient’s visit. 

1.2 All users of the Service must agree to this Network Terms of Use agreement before accessing the internet. 

1.3 CORA Health Services, Inc. does not guarantee the uptime of this Service or any particular rate of speed. CORA Health Services, Inc. also does not have any control over any information received by you from internet sources visited through the Service and shall not be liable for the accuracy of any such content. 

1.4 Use of the Service is at your own risk. 

1.5 CORA Health Services, Inc. reserves the right in its sole discretion to remove, block, filter, or restrict, by any means, any material transmitted or received on the Service which may be illegal orsubject CORA Health Services, Inc. to liability, or that otherwise violates this Network Terms of Use agreement. 

1.6 CORA Health Services, Inc. may cooperate with legal authorities and/or third parties in an investigation of any suspected or alleged crime or civil wrong doing in connection with the Service. 

1.7 Violations of this policy may result in the suspension or termination of your access to the Service.

2. Responsibilities of the User

2.1 You acknowledge and agree that you are responsible for making sure your device has the most updated version of anti-virus protection and security patches installed. 

2.2 You acknowledge and agree that when you connect your device to the internet, including by use of the Service, you may expose your device(s) to things including, but not limited to:
	(a) Viruses and Trojans; 
	(b) Denial-of-service-attacks;
	(c) Intrusions and packet sniffing; and
	(d) Other abuses by third parties.

2.3 While using the Service, you agree to adhere to and respect all copyrights and any other intellectual property rights of other parties. Downloading and/or distribution of copyrighted material is strictly prohibited.

2.4 Any operation of any programs, services, systems, processes, or servers by a single user or a group of users, which may degrade or affect the accessibility of the Services is prohibited and will not be allowed.

2.5 Connecting to or using “Peer to Peer” services is strictly prohibited and will be blocked for use on the Service.

2.6 Using the Service to access someone else’s computer, any type of account (e.g. – Email Account or Computer Account), or data without permission is prohibited.

2.7 Any Attempt to circumvent or subvert CORA’s network security is prohibited.

2.8 Saturating network or computer resources to the exclusion of another's use, for example, by overloading the network with traffic such as emails or legitimate (file backup or archive) or malicious (denial of service attack) activity, is prohibited.

2.9 By using the Service you further acknowledge and agree that wireless Internet access is inherently not secure, and you should adopt appropriate security measures when using the Service. CORA Health Services, Inc. highly discourages users from conducting confidential transactions (such as online banking, credit card transactions, etc.) over any wireless network, including this CORA’s Guest WiFi Network. You are responsible for the security of their own devices.

3. Limitations of Wireless Network Access

3.1 CORA Health Services, Inc. is not liable for any damage, undesired resource usage, or detrimental effects which may occur to your device and/or software while using the Service.

3.2 The user is responsible for any actions taken from his or her device, whether intentional or unintentional, that damage or otherwise affect other devices or users of the Service.

3.3 You hereby release CORA Health Services, Inc. from any and all liability in connection with  any loss, damage, security infringement, or injury which you may sustain as a result of accessing the Service. You acknowledge and agree that you are solely responsible for any such loss, infringement, damage, or injury in connection with your use of the Service.

4. Terms of Service

4.1 By clicking the accept button, you hereby agree to comply with and to be legally bound by this Network Terms of Use agreement. If the Network Terms of Use agreement or any other terms in connection with the Service are or become unacceptable to you, your right to use the Service shall terminate and you shall immediately disconnect your device from the Service.

4.2 By using the Service and therefor accepting this Network Terms of Use agreement, you also hereby provide your consent, and otherwise acknowledge, and agree that CORA Health Services, Inc. may monitor, log, store and review any network activity on the Service that is created by a device you connected to the Service. CORA Health Services, Inc. will use this information we collect from the Service to uphold the terms of this Network Terms of Use agreement and to ensure fair use of the Service for all users. Please be aware that any network activity logs may also be produced and given to law enforcement in the event there is any criminal or civil case brought against you in conjunction with your use of the Services.

4.3 You also hereby acknowledge and agree that CORA may store any information collected pursuant to Section 4.2 of this Network Terms of Use agreement for a period of no less than 10 years.

5. Lawful Use

5.1 This Service may only be used for lawful purposes. 

5.2 The Service shall not be used in a manner which would violate any law or infringe any copyright, trademark, trade secret, right of publicity, privacy right, or any other right of any person or entity.

5.3 The Service shall not be used for the purpose of accessing, transmitting, or storing material which is considered obscene, libelous or defamatory. Illegal acts may subject users to prosecution by local, state, federal, or international authorities. CORA Health Services, Inc. may bring legal action to enjoin violations of this Network Terms of Use agreement and/or to collect damages, if any, caused by violations.

5.4 You acknowledge and agree that you will use the Guest WiFi Network only as permitted by applicable local, state, federal, and International laws; andwill refrain from any actions that may be considered to be negligent or malicious.

5.5 You acknowledge and agree that you  will not send email containing viruses or other malicious or damaging software and that you will run appropriate anti-virus software to remove such damaging software from your device.

5.6 You acknowledge and agree that you will not access web sites which contain material that is grossly offensive to CORA Health Services, Inc. or its employees, patients, representatives, and agents, including any material containing clear expressions of bigotry, racism, or hatred. You further acknowledge and agree that you will not access web sites which contain material that defames, abuses, or threatens others.

6. Changes to the Guest WiFi Network

6.1 CORA Health Services, Inc. reserves the right to change the Service, any features of the Service, the terms of this policy, or any part of CORA’s network without notice to the user.
